General Terms and Conditions of Service
Effective from 1 Feb, 2025
These terms and conditions apply to all our classes, programs and private coaching sessions involving students and our coaches.
Who do these Terms and Conditions apply to:
Us, We, Our means 22 West Pty Ltd trading as Powergoal Academy ACN 665 179 788 of McEwen Reserve (Multipurpose 1), Shepparton VIC 3660.
You, means person / persons, adult, parent, carer, legal guardian who attend the Class and/or Program or any part of it, with the Student and who is responsible for payment of all Fees associated with our services.
In these Terms and Conditions the following additional definitions apply:
Definitions
“Coach” means the individual(s), employed by Powergoal Academy. Whilst every effort will be taken to maintain the consistency of the Coaches during the Class, Powergoal Academy unreservedly retain the right to change the coaching staff where necessary.
“Class” means the Powergoal Academy services which relate to our Student weekly small group sessions.
“Program” means the Powergoal Academy services which relate to our Student Holiday Camp, Masterclass or Workshop.
“Private Coaching” means the Powergoal Academy services which relate to our Student Private Coaching sessions
“Registration” means the online short form relating to the enrolment of the Student.
“Fees” means the cost per Class as specified on our website.
“New Student” refers to minors (persons under the age of 16 years) who are attending Class for the first time.
“Student” refers to minors (persons under the age of 16 years) who attend Class on a weekly basis and/or are registered to attend a Program or Private Coaching Sessions.
“Non Student” refers to minors (persons under the age of 16 years) who are not registered to attend a Class and/or Private Coaching Sessions
“Premises” means the venue at McEwen Reserve (Multipurpose 1), Shepparton VIC 3660, or as otherwise scheduled.
“Terms” means these terms and conditions and any special conditions agreed in writing by Powergoal Academy and You.
1. Acceptance of Terms and Conditions
Please read these terms carefully prior to booking. These terms tell you who we are, how we will provide services to You and Students.
To attend a Class, You (on behalf of the Student) must agree to the Terms and Conditions set out below. These Terms shall be deemed to have been accepted by You upon payment of Fees by or on behalf of You.
All agreements relating to the teaching of the Class and/or Program by Powergoal Academy to the Student are subject to these Terms to the exclusion of all other terms and conditions.
In the unlikely event You fail to abide by these Terms and Conditions, we may discontinue, cancel or suspend Your agreement with Us.
You agree to keep the content of the Powergoal Academy Class and/or Program confidential and not to copy or use any aspect of the Powergoal Academy Class and/or Program directly or indirectly. You agree not to directly or indirectly manage, operate or assist in the organisation of any business which competes with Powergoal Academy while the Student is a member of Powergoal Academy and for a period of two years afterwards.
2. General Business Terms & Conditions
Powergoal Academy reserves the right to limit the number of Participants in its Class and/or Program.
Powergoal Academy reserves the right to change venue within 10km of the originally nominated venue in the event of inclement weather.
In the event of inclement weather Powergoal Academy reserves the right to extend the period of the Class and/or Program by one day and/or an afternoon session, to ensure completion of the required hours of instruction.
Students are required to wear shin pads, football socks, and soccer boots to all Classes and Programs. Futsal shoes or Joggers/trainers (preferably with clear/white sole) are required should it be necessary to attend an indoor facility.
No Non Student shall take the place of any registered Student at a Class and/or Program for any reason without the full knowledge and consent of Powergoal Academy and the appropriate forms being completed for insurance purposes and fees being paid.
All registration forms must be processed through Powergoal Academy’s website.
Please note that any property left behind at Classes and/or Programs will be kept for a period of one month and if not claimed then will be donated to charity.
Students agree to abide by all policies implemented by Powergoal Academy.
Powergoal Academy will not be responsible for any loss, damage or injury arising directly or indirectly in connection with the participation of yourself and or your child / children in any Powergoal Class and/or Program, conducted by or on behalf of Powergoal Academy. The applicant acknowledges and agrees that in registering yourself and or your child / children in the Class and/or Program you do so at your own risk and you accept the risks of you and or your child / children participating in such Class and/or Program. You hereby release and discharge Powergoal Academy, its related bodies corporate and its servants and agents, from any claims which you and or your child / children now or at any time may have in connection with or incidental to your and or your child / children’s participation in the Class and/or Program.
Nothing in this waiver is intended to exclude anything, which cannot be excluded by law. In the event of an injury or illness to you and or your child / children, you hereby consent to Powergoal Academy, its employees and agents arranging any medical treatment that may be required (including, without limitation, any ambulance transport). You agree to pay on demand all medical costs incurred in relation to any injury or illness to you and or your child / children that are not already covered by your own private health fund or Medicare.
3. Class, Program and Private Coaching Sessions
You are the responsible adult for Your child(ren) at all times when attending the Premises. For Health and Safety purposes please supervise your child(ren) and or the Student at all times at the Premises.
Please help us start and finish Classes on time by arriving promptly for Classes. Please let the coaching team know if You leave the Class early.
You must ensure that all siblings, prams and associated equipment is kept off or as far back from the playing area at the Premises at all times.
You may provide water at the Premises, but no food / water must be consumed on the playing area at the Premises.
Please try to keep noise and disturbance from the sidelines of the playing area to a minimum to avoid distracting Students.
Please ensure the Student is wearing athletic clothing and proper footwear during Classes, Programs and/or Private Coaching Sessions.
4. Booking Policy
Booking a Class, Program and/or Private Coaching Session
You can make a Class, Program or a Private Coaching Session booking online at www.powergoal.com.au
You must provide us with certain personal information to book a Class, Program or a Private Coaching Session with us. For details of the information we collect please refer to our Privacy Policy here.
During the Private Coaching Session booking process, you will have access to the Coach’s calendar to book a time that suits you and the Coach.
All Class timetables are correct at time of publishing. If your Class time/location changes, the Coach will contact you.
All of our prices include GST where applicable
5. Payment Policy
Class, Program and Private Coaching Fees & Payment
Class Registration must be paid for per Class in advance and in full prior to the Student commencing the Class.
Fees are non-refundable under any circumstances whatsoever except with the prior written agreement of Powergoal Academy (and subject to terms and conditions provided for in this Agreement). In the event of a Student not being able to attend Class, Program and/or Private Coaching Session a credit will be issued and can be used at a later date.
If we cancel Classes, Programs and/or Private Coaching Sessions for reasons out of our reasonable control (such as due to an “Act of God” (e.g. disruption resulting from extreme weather conditions, earthquakes, etc), strikes, terrorist activity, or where local authorities/public guidance advise that classes should be temporarily suspended for health or other reasons), then no refunds shall be given and the Student will receive a credit to attend the next scheduled Class to the same value.
If your Class Fees change You will be notified of Your revised payment schedule via email.
Payment will only be acceptable via Our website www.powergoal.com.au.
6. Cancellation Policy
Class, Program and Private Coaching Cancellation
Powergoal Academy reserves the right to cancel any of its Classes, Programs and/or Private Coaching Sessions at any time but will endeavor to give at least 24 hours notice prior to the event.
If in the event of a Class, Program or Private Coaching Session being cancelled due to inclement weather, the Student will receive a credit to attend the next scheduled Class, Program or Private Coaching Session to the same value.
If the weather is inclement Students must attend the designated venue each day. The Coach‘s decision on Class, Program and Private Coaching Session commencement, postponement or cancellation shall be final.
In the event of a Student not being able to attend a Private Coaching Session, the Student will receive a credit to the same value to be used at a later date.
Classes can be cancelled anytime on our website. In the event of the Student not being able to attend Class, the fee is not refundable. If you paid for a Class and the Student is not able to attend, there will be no refunds given for that Class as we offer services on a first in, first served basis. The weekly fee for the Class guarantees the Student a spot in the Class/Academy on an ongoing basis.
7. Social Media Policy
The applicant understands that you and or your child / children may be photographed while participating in the Class, Program and/or Private Coaching Session and you hereby give permission for the use of your and or your child’s / children’s name and photographic likeness to be used in all forms of media for the promotion of any activity undertaken by Powergoal Academy or its related bodies corporate.
By registering a Student at Powergoal Academy, You agree that photographs and videos of the Student may be taken during sessions for promotional purposes, including use on our social media platforms, website, and marketing materials.
If You do not consent to the Student being photographed or filmed for these purposes, You must inform us via email (hello@powergoal.com.au) at the time of enrolment or at any time thereafter.
We will take all reasonable steps to ensure that any Students who are not to be included in social media or promotional content are excluded from such materials, provided we have been given clear notice.
8. Refund Policy
These Terms & Conditions apply to any purchases of goods or services on the website.
You must pay the price specified in respect of all goods or services purchased on the website before any goods or services will be supplied to you. Prices are in Australian dollars (AU$) and include GST where applicable, except where specified otherwise.
Classes - Powergoal Academy enforces a strict no-refund policy for all cancellations, including cancellations due to sickness, non-attendances, late arrivals, or failure to participate. In the event of a Student not being able to attend a Class, the Student will not receive a credit. The only exception will be if a Class is cancelled by Powergoal Academy due to inclement weather.
Programs and Private Coaching Sessions - Powergoal Academy enforces a strict no-refund policy for all cancellations, including cancellations due to sickness, non-attendances, late arrivals, or failure to participate. In the event of a Student not being able to attend a Program and/or Private Coaching Session, the Student will receive a credit to the same value to be used at a later date.
Where goods or services are provided by a third party (even where promoted on the Site), that third party is solely responsible for those goods or services.
9. Discount Policy
Coupon Codes
From time to time, Powergoal Academy may offer Coupon Codes which may apply to any, or certain specified Class, Program and/or Private Coaching Session bookings or purchases made through the Powergoal Academy website.
Each coupon code will be subject to specific Terms and Conditions specified at the time the code is issued (including the length of time to use the code) in addition to those mentioned here.
Only one coupon code can be used for a Class, Program and/or Private Coaching Session booking at any one time.
A coupon code can't be applied to a booking after that booking has been placed.
If the coupon code has expired, you won’t be able use it.
If a coupon code is offered by Powergoal Academy and can’t run properly because of fraud, tampering, technical errors or anything else that is beyond our control which affects the running, administration, security or fairness of the coupon code, we reserve the right to cancel, modify or suspend the coupon code.
Coupon codes are non-transferable and cannot be exchanged for cash.
If a single use coupon code is provided specifically to you for your own individual use, you must keep it confidential and only use it for making your own bookings or purchases on the website.
Powergoal Academy can’t accept any responsibility once we have given you the code and we are not obliged to provide you with a replacement if it gets lost and/or gets used by someone else as this will result in the coupon code being cancelled.
10. Indemnity & Release
The applicant must understand that registering for a Class, Program and/or Private Coaching Session affects their legal rights.
The applicant understands that there are certain risks involved in the sport/activity that could result in injury and/or death. Football involves tackling and body contact which could lead to serious injury and/or death.
The applicant registers for a Class, Program and/or Private Coaching Session in full knowledge that they have read the preceding document and understands it in full.
Powergoal Academy reserves the right to amend these Terms and Conditions at any time.
11. Your Responsibility
You warrant and represent that;
The information You provide in the Registration Form (whether or not completed and/or signed by You) is accurate in all respects, and You will notify Powergoal Academy of any changes immediately.
When attending our Classes, Programs and/or Private Coaching Sessions, neither the Student nor You (or any other person attending the Premises with the Student for a Class, Program and/or Private Coaching Session) will be suffering from any contagious illness, disease, injury or anything similar thereto.
You acknowledge and agree that the Student shall be deemed to be under the direction, care and control of You at all times at the Premises and in participation during any Class, Program and/or Private Coaching Session; and You shall be responsible for the welfare and conduct of the Student throughout the Class, Program and/or Private Coaching Session and whilst the Student is on the Premises.
By agreeing to being bound by these Terms and Conditions, you represent and warrant that you are at least 18, or if you are entering into these Terms and Conditions on behalf of any person under 18, that you are that person’s parent or legal guardian. You must inform any persons under 18 about these Terms and Conditions and their obligation to comply with them.
Persons under 5 years may only participate in Academies with the prior consent of Powergoal Academy.
Where you are entering into these Terms and Conditions on behalf of the person under 18, you warrant that you are solely responsible for the participant getting to and from the place at which the services are provided. You acknowledge that Powergoal Academy has no responsibility.
You shall full indemnify and keep indemnified Powergoal Academy (and its representatives and personnel) against all injury, loss (including loss of profit), liability, costs and expenses which Powergoal Academy shall incur directly or indirectly as a consequence of any action or inaction of You or the Student.
You and the Student are expected to conduct in a civilised and respectful manner at all times towards the Coaches, staff, other customers and any members of the public who are on the Premises. In the event that Powergoal Academy determines the behaviour of the Student and/or You to be unacceptable, Powergoal Academy shall be entitled to exclude the Student and You (or either of them) from Class and Premises permanently or for such period as Powergoal Academy shall (in its entire discretion) determine appropriate.
The standard of behaviour which is to be regarded as unacceptable shall be determined by Powergoal Academy at its sole discretion.
No siblings of the Student are permitted to the Premises and on the only Students are to participate in the session at that time. Any sibling at the Premises is the responsibility of You at all times . If the sibling needs attention that requires You/Carer to leave the Premises, the Student must accompany You and must not be left with the Coach.
You accept that at times during any Class, Program and/or Private Coaching Sessions there may be appropriate physical contact between the Coach and the Student, which will always be carried out in a professional and caring manner.
When completing the online profile:
You must provide all information relevant to the supply the services, including all details requested.
You warrant that all information provided by you is correct, and that you will update any information that changes.
12. Complaint Policy
We hope you will be delighted with our service but if you are unhappy or wish to provide Feedback please follow the steps below:
(a) Speak to the Coach. We will make efforts to resolve the matter to your satisfaction.
(b) If Our response is not satisfactory, please send your complaint via email to hello@powergoal.com.au
13. Third Party Content and Links
This website may include third party content which is subject to that third party’s terms and conditions of use. Nothing on this website should be construed as granting any license or right for you to use that content.
This website may include links to third party sites which are not related to Powerogal Academy and in relation to which Powergoal Academy has no control or interest. The appearance of those links on this site does not indicate any relationship between Powergoal Academy and that third party or any endorsement by Powergoal Academy of that third party, its site or the products or services which it is advertising on this Site. You should take appropriate action to ensure that your access to, and use of this Site and other websites is protected against, and free from viruses, worms, trojan horses and other harmful and destructive material.

All intellectual property in relation to content on this website belongs or is licensed to Powergoal Academy or its affiliates. You obtain no interest in that intellectual property. All content on this website may be protected by Australian and international copyright and other intellectual property laws. You may not do anything which interferes with or breaches those laws or the intellectual property rights in the content.
You may download and view content or print a copy of material on this website for personal, non-commercial use provided you do not modify the content in any way (including any copyright notice). All rights not expressly granted under these terms of use are reserved by Powergoal Academy. Unless expressly stated otherwise or as permitted under the Copyright Act 1968 (Cth), you are not permitted to copy or republish anything you find on the website without Powergoal Academy’s permission.
Nothing displayed on the website is construed as granting any license or right of use of any logo or trade mark displayed on the website without the express written permission of the relevant owner.
